Srinagar, Mar 04: The Jammu and Kashmir administration Thursday directed the Administrative Secretaries, Divisional Commissioners, Deputy Commissioners and head of the departments to ensure no new entrant in the Government Service is paid salary, allowances till verification by the Criminal Investigation Department (CID)
The circular issued by the Commissioner/Secretary to Government, Manoj Kumar Dwivedi states that some dubious characters have been paid salaries and other allowances, without obtaining their mandatory CID verification.
The officers concerned have been asked to identify such cases and ensure that their verification is completed expeditiously.
“In terms of Government Order No. 1918-GAD of 1997 dated 09.12.1997, read with Government Order No. 1328-GAD of 2016 dated 07.12.2016, security clearance from the Criminal Investigation Department (CID) has been made mandatory for drawing salary and allowances of new entrants into Government Service,” the circular reads.
It further states that it has, however, been observed that these instructions are not being adhered to in some Departments/Subordinate offices, as a result of which many individuals with dubious character antecedents and conduct have been paid salaries and other allowances without obtaining their mandatory CID verification.
“It is accordingly impressed upon all Administrative Secretaries/Divisional Commissioners/Deputy Commissioners/Heads of the Departments and Managing Directors of all PSUs/Corporations to identify such cases and ensure that their verification is completed expeditiously and no new entrant in the Government Service is paid salary/allowances till verification by the CID,” the circular added.
The circular states that further with a view to expedite verification process, a simplified mechanism has been devised in consultation with the Criminal Investigation Department, which is enclosed as Annexure-A to this circular and may be adopted.kno

Srinagar, Feb 27: The Jammu and Kashmir health department has cancelled the appointment of 90 newly recruited Medical Officers (MO) for failing to join their duties.
To augment the healthcare facilities in the rural areas, the Public service Commission (PSC) last month recommended sanction for temporary appointment of 153 doctors as Medical Officers subject to various conditions.
The Health and Medical Education Department Friday in an order said that the Directorate of Health Services, Jammu and Kashmir on 17 February furnished details of 90 MOs who have failed to join their places of postings.
The 90 doctors include 66 from Jammu division and 24 from Kashmir division.
“Therefore the appointment of 90 medical officers, appointed vides order no: 56-HME of 22-01-2020, are hereby terminated and they are discharged from services,” reads the order.
The health department has also received inputs about some doctors who after submitting their joining reports are not physically continuing at their respective place of postings are pursuing postgraduate courses in medical colleges.
“It is clear violation of norms. They have been given final opportunity to resume duties failing which they shall be deemed to have been discharged,” said an official of the health department.
Notably, in 2019 also, the health department had appointed 921 MOs out of which some 500 had joined their places while the rest were later dismissed from the services.
From 2018, the J&K government decided not to allow appointees to continue with their postgraduates/demonstrations in medical colleges.
They have only one choice either to opt for an appointment or opt out and go for studies and next candidates from waiting will be considered for appointment.
The department has said that it was working on implementing transfer policy in letter and spirit to make sure that fresh recruits serve in far off areas for at least six years.
The department is facing a huge problem as doctors are leaving for the Middle East and West after completing their studies at government expenses in Jammu and Kashmir.
As per the recent Economic Survey report, the doctor-patient ratio in J&K is 1:1,658 as against the recommended norm of the World Health Organization which is 1:1,000.

For the first time after the abrogation of Article 370 of the Constitution on 5 August 2019, the government in the Union Territory (UT) of Jammu and Kashmir has begun a process to terminate services of the employees involved in “anti-national” activities State Times reported.
According to some highly placed authoritative sources, 500 to 1,000 government employees, “posing threat to security and integrity of the State”, could be dismissed in the next two or three months.
On the basis of intelligence reports, Government has learned much more than the sworn separatists and militants, a section of its own employees was proactively promoting anti-India hatred, assailing New Delhi’s decisions of 5 August 2019, trolling and threatening politicians, government officers and businesspersons on social media-WhatsApp groups, Twitter, Facebook and Instagram. Besides, the decision of dispensing with the services of over 200 employees, including Police personnel in league with terrorists or charged with dereliction of duty, had remained pending for legal and technical hitches since long.
On Thursday, 30 July 2020, General Administration Department (GAD) of the Jammu and Kashmir Government decided to invoke a special provision of the Constitution of India for the purpose of terminating the services of the employees or reducing their ranks without holding an inquiry but on the basis of relevant records and other collateral evidence.
Article 311 of the Constitution empowers the government to dismiss the employees on the basis of an enquiry. However, most of the government employees’ dismissal orders in the past, when Jammu and Kashmir was a State, had been quashed by courts as the aggrieved petitioners disputed the procedure or called the inquiry as ‘flawed’. Now the UT government has invoked Clause (2)(c) of Article 311 that dispenses with the prerequisite of inquiry in the matters where the President or the Governor, as the case may be, is satisfied that in the interest of the security of the State, it is not expedient to hold such inquiry.
Under the GAD order, the Government has constituted a 6-member committee which would be processing for dismissal or reduction of rank all the cases to be referred to it by any department or Police through Home Department after scrutiny. Chief Secretary, Secretary GAD, Secretary Law, Secretary Home, Director General of Police and Additional DGP Criminal Investigation Department have been appointed as its members.
Dispensing with some previous checks and balances, the GAD order reads: *“The recommendations in respect of such cases shall be supported by relevant records which may include a copy of the interrogation report and other collateral evidence to justify dispensing with the holding of an inquiry in the interest of security of the State”*. The Department of Law and GAD would process and scrutinise the cases but clearly the opinion of the Home Department and Police would be pivotal in taking a decision.
After the split of the erstwhile State into two UTs, the total number of the J&K UT employees is around 4,50,000.
A section of the government employees in the Kashmir valley has been part and parcel and promoter of the separatist narratives since long. Successive governments have occasionally taken action against them but, quite often, orders of their dismissal have been quashed by different courts on the technical grounds. Government has often failed to dismiss even the employees who did publicly support separatists and terrorists or worked as terrorists or their over-ground activists without ever discharging duties as public servants.
The first major action against the employees posing threat to security of the State was taken by then Governor Jagmohan when he terminated the services of three professors- Abdul Gani Bhat, Abdul Rahim and Shariefuddin-on 27 February 1986. In less than a month, the dismissed professors formed Muslim Employees Front (MEF). Within weeks, Muslim United Front (MUF) was born out of MEF. Prof. Abdul Gani Bhat played a key role in forming MEF, MUF and subsequently its third generation amalgam, All-Parties Hurriyat Conference (APHC) in 1993. Bhat held several terms as Chairman in all the three organisations.
In 1989-90, around 100 Police personnel deserted and joined the militant ranks. Some of them like Ali Mohammad Dar, who towards his end in 1998 was Hizbul Mujahideen’s “Chief of Operations” with code-name of Burhanuddin Hijazi, were killed in different encounters. A few dozens of them were arrested and dismissed from service. Same groups of Policemen caused a major bomb blast at the office of Director General of Police in January 1992.
According to senior officers, around 300 Policemen have been dismissed in the 110,000-strong Police organisation in the last 30 years for being a threat to the security of the State. They include over a hundred personnel who organised a major Police agitation in Srinagar in April 1993.
Others lost their job for dereliction of duty, including failure to protect their arms and protected persons. Of late, Deputy Superintendent of Police Davinder Singh has been arrested and dismissed for his association with Hizbul Mujahideen.

The ban on inter- district and inter – division recruitment is no more applicable in Jammu & Kashmir as any domicile of the Union Territory can apply for any district and divisional cadre post.
Under the new recruitment rules unveiled by the government for class 4th posts, 5-10 additional marks will be given to candidates of home districts and divisions for the posts mean for their respective districts and divisions.
Before August 5, 2019, the district and divisional cadre posts were reserved for candidates of respective districts and divisions. “Previously, a candidate could apply for district cadre post only in his/her native district and divisional cadre post only in his/her home division. Now, any domicile of J&K can apply for any district and divisional cadre post,” they told that adding, that 5 to 10 extra marks will be given candidates of home districts and divisions for posts meant for their districts and divisions.
The J&K legislature had banned inter-district and inter- division recruitment after amending the Jammu and Kashmir Civil Services Decentralisation and Recruitment Act-2010. According to new rules, five marks will be given to candidates of home division for divisional cadre posts and 10 marks will be awarded to candidates of home district for district cadre posts.
The new rules have been framed by the administration under powers conferred by proviso to Article 309 of Indian Constitution read with Section 15 of J&K Civil Services (Decentralisation and Recruitment)
Act, 2010. It is worthwhile to mention here that all jobs in Jammu and Kashmir have been reserved for its domiciles after Centre amended the J&K Civil Services (Decentralisation and Recruitment) Act, 2010 in April this year—(KNO)

300 Posts Of Management Trainees To Be Filled By Bharat Sanchaar Nigam Limited {BSNL}
Bharat Sanchar Nigam Limited has invited applications for 300 posts of management trainees, of which 150 posts will be filled from outside candidates, and the rest from internal candidates.
The online registration for these jobs will start on December 26, which will go on till January 26, 2019. The online assessment of the forms will be held on March 17, 2019.
The age of the candidates applying for these posts should not exceed 30 years as of August 2019. However, the upper age limit in case of SC/ST candidates has been relaxed by 5 years; OBC category candidates by 3 years; PWD (person with a disability) general candidates by 10 years; PWD SC/ST candidates by 15 years; and PWD OBC candidates by 13 years. Ex-servicemen and residents of Jammu and Kashmir will also get relaxation as per the Central government rules.
The management trainee will be appointed in the pay scale of Rs 24,900-50,500 with an annual increment of 3 per cent of basic pay, besides other benefits like HRA, medical benefits, etc.
Bachelor of Engineering or Bachelor of Technology degree or equivalent engineering degree in telecommunications, electronics, computer/IT and electrical with minimum 60 per cent marks (55 per cent for SC/ST candidates). T

State government said that it will conduct 17062 additional non-gazzetted recruitments in different wings ofJammu and Kashmir police (JKP) by 2020-21.
It said that 8531 posts of inspector, sub-inspector, additional sub-inspector and head constable and similar number of posts (8531) of constables will be created in a phased manner in different wings of the police.
Government order number 1616-Home of 2018 dated November 28, 2018 said that in the first phase (2018-19), 1822 recruitments of inspec tor, sub-inspector, additional
sub-inspector and head constable will be made in the executive wing of the police, 569 in armed wings and 456 in other wings.
In the second phase, (2019-20), 1820 recruitments of inspector, sub-inspector, additional sub-inspector and head constable will be made in executive, 567 in armed and 455 in other wings of the police, while in the third phase (2020-21), 1820 recruitments of inspector, sub-inspector, additional sub-inspector and head constable will be made in executive, 567 in armed and 455 in other wings of the police.
As far as recruitment of constables is concerned, in the first phase (2018-19), 1822 posts will be filled up in executive wing, 569 in armed and 456 in other wings. In the second phase (2019-20), 1820 posts will be filled up in executive, 567 in armed and 455 in other wings of the police.
In the last phase (2020-21), 1820 posts of constables will be created in executive, 567 in armed and 455 in other wings of the police.
The order further said that 17062 posts were created vide government order number 1392-Home of 2018 dated October 6, 2018.

J&K Services Selection Board (JKSSB) today approved cancellation of recommendations/candidature of 71 candidates to pave the way for operation of waiting list.
According to Malik Suhail, PRO, JKSSB, the 71 recommendations/candidature cancelled by the Board includes69 posts of Accounts Assistants selected earlier for district cadres of Anantnag, Budgam, Pulwama, Kupwara and Jammu. He said the recommendations of these candidates had been withheld for completing deficiencies, which they failed to do within the stipulated time-frame.
Malik said these candidates were required to furnish the clarifications/deficient documents in respect of their candidature, but they failed to do so, despite repeated notices by the Board. “The Board considered the issue and keeping in view the fact that such candidates were not interested in being recommended against these posts and at the same time the validity period of these selection lists was nearing expiry, JKSSB decided to cancel their candidature/ selection, to pave the way for candidates figuring in the waitlists to get a chance of employment,” he said.
He said the candidates in the waiting list should immediately approach the concerned departments for availing the benefit of these cancellations.

1000 Medical Officers Selection To Be Completed By 15 December: JK Gov Satya Pal Malik
Governor Satya Pal Malik today called for expeditious completion of all necessary infrastructural and other facilities to ensure that the 5 new medical colleges in the state start functioning from the next academic session.
He also directed for fast-tracking recruitment of faculty and para-medical staff and completing all necessary requirements to fulfill the MCI norms for formally starting the academic activities in these colleges next year.

Reviewing the functioning of the Health &Medical Education Department here this evening, Governor directed the Principal Secretary, Health & Medical Education to personally monitor the progress of these colleges and maintain close coordination with the PSC/SSRB and executing agencies for early selection of all referred posts and putting up the requisite infrastructure in place within the set timeframe.
Pertinently, the five new Medical Colleges are coming up at Rajouri, Doda, Kathua, Anantnag and Baramulla for which Government of India has sanctioned Rs 189 crore each.
While updating on the present status of these colleges, Principal Secretary, Health & Medical Education, in his power-point presentation informed that work on all five colleges is in full swing and likely to be achieved as per target. He said the construction activities are being monitored regularly with the concerned agencies and emphasis is laid to ensure timely completion of these projects.
Regarding recruitment of faculty and other staff, the Principal Secretary informed that all posts stand created and referred to the concerned recruitment agencies viz; JKPSC and JKSSRB and are being vigorously pursued for the fast-track recruitment to ensure early commissioning of these colleges. He also informed that necessary steps are being taken to arrange make-shift accommodation for these colleges before the visit of MCI team in December this year.
He said 3375 posts including doctors, para-medical and other staff stand already created for these medical colleges out of which 2225 vacancies including 330 faculty positions and 1895 para-medical vacancies have been referred to the recruiting agencies including JKPSC and JKSSB respectively.
Governor observed that health is the primary need of every individual and called for renewed efforts to upgrade the facilities in every health institution, especially in the far-off areas. He directed the Principal Secretary Health & Medical Education to ensure regular review of facilities with the field functionaries to plug the gaps, if any at the grassroots level. He directed for reviewing the supply position of medicines, diagnostic equipment and human resource to ensure hassle-free healthcare services for the people.
Atal Dulloo informed the meeting that to overcome the paucity of doctors, 1000 posts of medical officers have been referred to the PSC which are likely to be selected soon. Besides, 535 doctors have been engaged under NHM in the far-flung areas to supplement the services. In view of the dearth of Dental Surgeons, a proposal for the creation of 587 Dental Surgeons has been submitted to the Finance Department for approval. Similarly, 115 posts of Medical Officers in ISM Sector have also been referred to PSC for early selection, said the Principal Secretary.
Giving update on filling of the vacancies, Chairman, JKPSC, Latief-u-Zaman Deva apprised the meeting that process for recruitment of 1000 posts of Medical Officers and 115 posts of Medical Officers, AYUSH has been fast-tracked and assured to make selection by December 15, 2018. He also assured to finalize selections for the Faculty Members for the five medical colleges well in time to ensure timely commencement of academic session.
Governor also took stock of the preparedness for the formal launch of national flagship programme “Pradhan Mantri Jan Arogya Yojana-PMJAY” under Ayushman Bharat and directed for clearing all bottlenecks to ensure formal rolling out of this ambitious project on Ist of December, 2018. He urged the Chief Secretary to obtain regular feedback on the progress from all stakeholders to enable launch of the programme on scheduled date.
Briefing on the launch of Ayushman Bharat, it was informed that all necessary steps have been put in place to ensure this ambitious project on the scheduled date. The Principal Secretary informed that for the awareness of people the authorities have started door-to-door campaign, launched Ayushman Rath, publicity through print and electronic media and other activities to popularize the programme so that all targeted beneficiaries are covered. The process for issuance of Golden Cards and Prime Minister’s letters to the individual beneficiaries has also started and shall be completed by 15 December 2018, he added.
The Advisors, Kumar and Sharma and Chief Secretary BVR Subrahmanyam also put forth various valuable suggestions on how to further improve the healthcare facilities in the State.

Militants on Friday evening attacked the office of Assistant Superintendent of Police (ASP)in south Kashmir’s Shopian district.
A police official said the militants opened fire on the ASP’s office in Gagran area on the outskirts of town.
The policemen, according to the official, immediately retaliated, forcing the militants to flee from the spot.
The official, however, said that no casualties were reported in the exchange of fire.
Earlier in the day, a soldier was injured when militants attacked an army camp in Mantribugh village of the district.

Applications are invited from the students belonging to Denotified, Nomadic and Semi-Nomadic Tribes (DNTs) of Kashmir Province pursuing education under Pre-matric in Govt./Govt. recognized private schools/ institutes during the year 2018-19 to be awarded by the Ministry of Social Justice and Empowerment, Govt, of India, who are not covered under the Schedule Caste, Schedule Tribes and Other Backward Classes and whose annual family income is less than Rs. 2.00 lacs.
The following three castes of Kashmir Division have been identified as Denotified tribes :

The objective of the scheme is to empower Chopan, Pohul and Sangtrash socially as well as economically. This scheme will be of continuous and permanent nature.

Rural Development Department Directed By High Court To Convene DPC To Consider Eligible VLW”s As BDO’s
Justice Sanjeev Kumar directed Commissioner/Secretary Rural Development Department to immediately convene a meeting of Departmental Promotion Committee for considering the cases of all eligible Village Level Workers for their promotion to the posts of Panchayat Inspector Grade-II/Grade-I and the posts of BDOs.
The court further directed that the exercise shall be taken by RDD within a period of eight weeks from the date a certified copy of the order is made available to the RDD. These directions were passed in a writ petition filed by four in-charge BDOs Bahar Ahmed Wani, Baldev Singh, Miran Baksh and Khadim Hussain Shah seeking directions to RDD to convene a meeting of DPC so that they are substantively promoted to the post of BDOs as the petitioners are working as BDOs on in-charge basis since 2016.
Advocates while appearing for the petitioners submitted that the petitioners were initially appointed as Village Level Workers in RDD and after stagnating for several years the petitioners were placed in the next higher post of Panchayat Inspector Grade-II in September, 2013, October, 2014 and November, 2017 respectively.

SAC Abolishes Interviews For Class IV Posts, Inducts 27 Officers Into KAS
Governor N N Vohra chaired the 5th meeting of the State Administrative Council at Raj Bhavan.
Advisors to Governor, B B Vyas, Vijay Kumar and Khurshid Ahmad Ganai besides Chief Secretary, B V R Subrahmanyam attended the meeting.
The SAC deliberated upon the various proposals submitted by Administrative departments for its consideration and approval.
It abolished interviews for all Class IV posts in the State.
This comes into effect immediately except for those posts for which selection process has already been initiated.
In future, all recruitment for Class IV posts under State, Divisional and District Cadres and also for Companies, Organizations and Bodies substantially owned or controlled by the Government, will be done through the Jammu and Kashmir Services Selection Board.
The General Administration Department will pool all the Class IV vacancies available in different Departments in the State at all levels and refer these to SSB. The SSB will draw-up a fixed Annual Calendar to ensure time bound selection against Class IV posts. The selection will be made based on merit secured in the written examination up to the level equivalent to the 10th standard.
This decision will be implemented through an SRO notification and will be a horizontal cross-cutting decision applicable to all existing Recruitment Rules of all departments/agencies. This decision will ensure transparency, fairness, accountability and equitable opportunities of employment to aspiring youth of Jammu and Kashmir at this level.

Great News! Empowered Committee Clears 21 Cases For Regularization Under SRO 520
Principal Secretary Finance Department Navin K Choudhary chaired the first meeting of the Empowered Committee constituted under SRO-520 to consider cases for regular engagement of casual/seasonal/need-based and other workers here today.
The Committee considered 50 cases of various departments and cleared 21 cases which include five in PWD, two in Home Department, three in Finance, 10 in PHE/I&FC and one case in Housing and Urban Development Department.
Nine cases of Industries and Commerce Department and 20 cases of Technical Education Department were returned for want of deficiencies in documents.
Being the first meeting, the Committee also discussed way forward for speedy consideration of cases and rules governing the regular engagement. The Committee decided that all cases cleared by the Empowered Committee will be given a unique Finance Department Code Number (FDCN) having five digits which will be a running number and will be unique to each of the person cleared for regular engagement.
This will facilitate not only identification but also determining the date of their discontinuation on superannuation.
The Committee also decided that the Finance Department will draft and circulate a Model Order of regular engagement which will be followed by all departments while issuing orders after clearance by the Empowered Committee.
The next meeting of the Committee will be held on July 6, 2018.
